First time Incoterms were elaborated in 1936 year, by International Chamber of Commerce in Paris, in order to unify the interpretation of trade deadlines. Till nowadays 6 new publications appeared. Incoterms in significant way reduce misunderstandings resulting from lack of precise acquaintance of trade practices. Applying the Incoterms formulas, in international contracts, the partners can be sure that they define responsibility of every side in simple, safe and comprehensible way.13th September 1999 year International Chamber of Commerces- ICC edited millenary elaboration of Incoterms 2000. The new elaboration takes into account electronic processing of trade documents, development of nowadays transport, as well as the problems with interpretation of formulas in previous publications.

Structure of the formula:
INCOTERM [ 3 letters ] + PLACE [ country alternately ] + " INCOTERMS 2000 CCI"
Incoterms rules do not occupy with the rights of taking over property but they regulate:
  • the division of costs connected with transportation of goods ( therefore Incoterms are helpful upon the calculation of prices )
  • moment of crossing the risk, from seller to buyer, in time of transportation,
  • and they are defined in 3 categories:
    • The Incoterms of sale on the beginning of dispatching, family E, C or F, where the importer bears the costs and risk, connected with principal transport.
    • The Incoterms of sale at the end of dispatching, the family D, where the exporter bears the costs and risk, connected with principal transport.
    • The Incoterms DAF, where exporter bears the costs of transport and risk, connected with transport, to particular border, behind which importer takes over the stick. .
During contract negotiation it is worth to go after independent insurance of goods during trip. In contract one should also specify the components of price, because in majority of countries duty is paid from FOB value of goods, not including the costs of transportation. It is worth to remind, that when buyer did not take over delivery, at the time when goods were placed at his disposal in appointed place and in co-ordinated deadline or when he did not notify the seller about deadline and place of acceptance.
